Why umbrella compliance matters more than ever

From April 2026, we’re seeing increased focus across the industry on umbrella company compliance and for good reason. This isn’t just a regulatory update. It directly affects your pay, your tax position, and your long-term financial security.

There are a number of broader changes happening across the market - here we’ve highlighted the most relevant ones for our freelancers and contractors.

First things first: What is an umbrella company?

If you’re contracting via an umbrella, you are typically employed by that company, which then:

  • Pays you via PAYE  
  • Handles tax and NationalInsurance deductions  
  • Provides employment benefitslike holiday pay and pension

Simply put, umbrella companies sit between you, the agency, (sometimes an MSP), and the end client managing payroll and employment.

Why this is such abig topic right now?

The key shift is aroundaccountability. Where tax isn’t handledcorrectly, liability can sit across the entire supply chain including:

  • The umbrella company  
  • The recruitment agency  
  • The MSP (Managed ServiceProvider)  
  • The end client  

This “joint and severalliability” approach is why compliance is now under such intense scrutiny.

What we’re seeing in the market  

Many end clients and MSPs arenow:

  • Reviewing and tightening their Preferred Supplier Lists (PSLs) for umbrella companies  
  • Reducing the number ofa pproved providers  
  • Taking a more active role incompliance decisions

This can sometimes mean changesto which umbrellas are permitted on specific assignments.

New oversight: Fair Work Agency  

From April 2026, the UK government is also strengthening worker protection through the introduction ofthe Fair Work Agency, with contact details expected to be made publicly available from 7 April.

This body is designed to:

  • Support workers in understanding their rights  
  • Provide a route to raise concerns  
  • Strengthen enforcement around fair pay and treatment

  • You risk losing genuineemployment rights and protections

High take-home pay that seems too good to be true usually is.

Employment rights: What you get with a compliant umbrella  

When you’re with a compliant umbrella company, you’re not just being paid - you’re employed. That means access to:

  • Statutory Sick Pay (SSP)  
  • Holiday pay  
  • Pension contributions  
  • General employment protections 

Many umbrella companies also offer benefit schemes for contractors, so it’s worth a quick chat with your umbrella to see what’s available.

A quick note on SSP,unfair dismissal, and broader rights

With ongoing updates tos tatutory payments, it’s worth understanding:

  • How sick pay works with yourumbrella  
  • When you’re eligible  
  • What policies are in place 

We recommend speaking to your umbrella company ahead of 6 April 2026 to understand any updated policies or new processes.

Currently, unfair dismissal typically requires 2 years’ service, with proposed reforms expected to reduce this to around 6 months (anticipated from January 2027). However, as many contractors work on shorter assignments, this may not always apply directly, but it remains an important wider shift in worker protections.

Final thought  

The industry is moving toward greater transparency, accountability, and worker protection, which is a positive step. But it also means the choice of umbrella company has never been more important.
